Terms of Service

Welcome to The Written Hug. These Terms of Service ("Terms") govern your use of TheWrittenHug.com (the "Site") and your purchase of our products and services. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are and what we do

The Written Hug is operated by Invenient Capital Partners ("we", "us", "our"). We sell greeting cards that are personalized with your message, written with a real pen in real ink by precision writing machines, and mailed on your behalf to a recipient you specify.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you represent that you meet this requirement and that all information you provide is accurate.

3. Orders and acceptance

Your order is an offer to purchase. We accept it when we send the order confirmation email. We may refuse, cancel, or refund any order at our sole discretion, including for suspected fraud, pricing or listing errors, content that violates these Terms, or limits imposed by our production partners. If we cancel after payment, we will refund you in full.

4. Pricing and payment

All prices are in US dollars unless otherwise shown. Prices include first class postage. Applicable taxes are calculated at checkout. Payment is processed by Shopify Payments or other processors shown at checkout; we do not store full payment card numbers. We may correct obvious pricing errors, including after an order is placed, in which case you may cancel for a full refund instead of paying the corrected price.

5. Your message and your content

You are solely responsible for the content of the message you submit. We print your message exactly as written, including spelling and punctuation, so proofread before checkout. You keep ownership of your message, and you grant us a limited, non-exclusive license to reproduce it solely to produce, quality check, and mail your order, and to retain order records as required by law.

6. Acceptable use

You may not use our service to create or send content that is unlawful; that harasses, stalks, threatens, or intimidates any person; that is hateful or discriminatory; that is defamatory or knowingly false; that is obscene or sexually explicit; that promotes violence or illegal activity; that infringes any copyright, trademark, privacy, or publicity right; that impersonates another person; or that targets a minor inappropriately. We may screen messages with automated and human review, and we may refuse, hold, cancel, and refund any order that we reasonably believe violates this section. Repeated or serious violations may result in a ban from the service.

7. Anonymous sending

We offer the option to sign a card "A friend who cares" instead of your name. Anonymity applies to the recipient only. We always know who placed the order, we keep order records, and we will disclose sender information when required by valid legal process or to prevent harm. Anonymous sending may not be used to harass, threaten, or distress a recipient, and we treat complaints about anonymous cards seriously, including banning senders.

8. Recipients and addresses

By submitting a recipient's name and address, you confirm you have a legitimate, lawful reason to send mail to that person and that, where required, you have a lawful basis to give us their information. We use recipient information solely to produce and mail the card. If a recipient asks us not to deliver future mail to them, we honor that request.

9. Production and delivery

Cards typically enter production within hours and are mailed within one business day. Delivery estimates are good faith estimates, not guarantees. Standard cards travel as untracked first class letters. Our Shipping Policy below describes timelines and remedies for late and lost mail.

10. Cancellations and changes

Because each card is made to order, changes and cancellations are only possible before production begins. Contact support@thewrittenhug.com immediately; we will try, but we cannot guarantee changes after checkout. See the Refund Policy.

11. Intellectual property

All designs and Site content are our property or our licensors' property. Purchasing a card gives you the physical card, not any license to reproduce the design.

12. Feedback

If you send us ideas or suggestions, you grant us the right to use them without restriction or compensation.

13. Third party services

The Site runs on Shopify. Production and mailing are performed with specialized printing and handwriting partners, and delivery is performed by national postal services. We are not responsible for failures of postal services beyond the remedies in our Refund and Shipping Policies.

14. Disclaimer of warranties

The Site and service are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Handwriting output may vary slightly from previews; minor variation in ink and stroke is a natural part of the product, not a defect.

15. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of any order or use of the Site is limited to the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, even if advised of the possibility. Some jurisdictions do not allow these limits, so they may not fully apply to you.

16. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and reasonable legal fees arising from your message content, your violation of these Terms, or your violation of any third party right, including claims brought by a recipient.

17. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law rules. Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for 30 days. Any dispute that cannot be resolved informally shall be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction. Nothing in this section limits rights you hold under mandatory consumer protection law in your place of residence.

18. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including postal disruptions, strikes, weather, power or network failures, and acts of government.

19. Changes, severability, entire agreement

We may update these Terms by posting a revised version with a new date; the version in effect when you order governs that order. If any provision is found unenforceable, the rest remain in effect. These Terms, together with our policies, are the entire agreement between you and us regarding the service.
